Beavers damning flood of warrantless cell phone tracking

Sen. Mae Beavers will introduce a bill after the General Assembly convenes its next session that would require police to obtain a warrant before collecting and searching cell phone location and related records, reports WBIR.

Beavers argues that the use of such data by police departments and by organizations such as the NSA violates the Fourth Amendment to the United States Constitution.


The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
